EDUCATION AND APPROACH
From the Theory of Proof to Complex Business Disputes
Nikolay Nemkov was born and grew up in Lesosibirsk, Krasnoyarsk Krai. In 2000 he finished school and entered the Law Faculty of Krasnoyarsk State University. He received his degree in 2007 from the Law Institute of Siberian Federal University.
His diploma thesis in criminal law was on the topic “Extortion of a Bribe” under the supervision of Alexander Solomonovich Gorelik. One of the most important university courses for him was Anatoly Sergeevich Barabash’s “Theory of Proof”.
This approach has remained in his practice: it is not enough to believe you are right — you need to understand what can actually be proven and how to build a working strategy from the evidence.

A Court Judgment Is Not the End Goal
This approach is especially visible in debt recovery. You can win a case worth tens of millions of rubles and obtain a writ of execution that does not lead to the money actually being returned. That is why the task is not simply to obtain a court judgment, but to assess how the client will receive an economic result after it.
Before a serious dispute begins, we analyze who the debtor is, what assets they have, where those assets might have been moved, whether there are grounds to challenge transactions, whether subsidiary liability arises and how realistic the economic result of the matter actually is.
The goal is not the court judgment in itself, but a result that has value for the client.

More Than RUB 100 Million in Additional Tax Assessments
In one of the matters, the tax authority refused the company the application of the 0% VAT rate under a foreign trade contract and assessed more than RUB 100 million in additional tax.
The problem was not only the size of the claims. If the additional assessments remained in place, the company’s manager faced the risk of criminal liability for non-payment of taxes.
The team reviewed the documents and the actual circumstances of the transaction, built a legal position and succeeded in having the additional assessments set aside.
The company retained more than RUB 100 million, and the risk of criminal law consequences associated with these additional assessments was eliminated.
